Do we each have to file for $4000 of the first time home buyers credit or can I file for the full $8000 because the mortgage is in my name?
The Deed is in BOTH our names
the mortgage is not relevant for who is eligible.
the person(s) who purchased home receive the credit. in other words whose names are on the deed.
so you both can receive $4,000 each.
I would argue to your fiancee you should get the entire $8,000 since you are at risk on loan. take the entire $8,000 and make a prepayment on your loan.

No.
It’s only if your name is on the deed.
PS: That wasn’t a smart financial decision to not put your name on the deed. You do realize that if your fiance (that is not your legal spouse) decides to kick you out…all she has to do is give you a 30-day notice because you do not legally own the house?
Yes…and you’ll still be stuck paying for it.
You had better fix that….QUICK!
